How much time do I have to file my personal injury claim in Washington, D.C.?

We can explain what time limits apply. Generally, you must file a personal injury claim within three years from when the claim accrues, often the date of the injury or accident. For a wrongful death claim, you generally have two years from the date of death of your loved one. Different time limits and notice requirements may apply for sexual assault claims, medical malpractice claims, claims against the government, and other actions.

In medical malpractice cases, plaintiffs may provide at least 90 days’ written notice before filing a lawsuit. The time that the clock begins on medical malpractice claims may begin from the date the plaintiff discovers or should have reasonably discovered the malpractice. The time for filing a personal injury claim may be tolled if the injured person is a minor or mentally incapacitated; different rules apply to wrongful death claims.
